§1. General provisions
- §1.1. These Terms govern use of the Miyū project: the Discord bot, https://miyubot.xyz/, the dashboard, Premium services, and the Miyū Support Server.
- §1.2. The service Operator (Administration) is the Miyū project team. Contact: https://miyubot.xyz/ or the support server.
- §1.3. Any use of Miyū services — including joining the support server, adding the bot, signing in, the dashboard, initiating or completing payments (Stripe), Premium subscriptions, donations, or trials — means automatic, binding acceptance of these Terms and the Privacy Policy without a separate checkbox, unless law requires another form of consent.
- §1.4. Users must comply with Discord's Terms, applicable law, and these Terms.
- §1.5. The Operator may update these Terms; the published version on the website applies. Not knowing the Terms does not exempt anyone from following them.
- §1.6. The Operator interprets these Terms within the law and for community safety; decisions may consider context and user history.
- §1.7. Continued use after Terms updates means acceptance of the new version; for payments, users should review current §8 before each new transaction.
§2. Behaviour and culture
- §2.1. Respectful behaviour is required; harassment, insults, provocation, and toxic conduct are forbidden.
- §2.2. Hate speech, discrimination, NSFW content, glorification of violence, and illegal content are forbidden.
- §2.3. Doxxing, sharing others' personal data without consent, and threats are forbidden.
- §2.4. Impersonating the Operator, team members, partners, or other users is forbidden.
- §2.5. Penalties may apply for conduct outside the support server if it concerns Miyū or its users (e.g. abuse of support staff).
§3. Channels and communication
- §3.1. Use channels according to their purpose (help, announcements, feedback, etc.).
- §3.2. Spam, flood, chain messages, and excessive pings (@everyone, @here, roles) without approval are forbidden.
- §3.3. Advertising servers, bots, commercial services, and affiliate links requires Administration approval.
- §3.4. Off-topic content may be removed if it disrupts support.
- §3.5. Polish is the main language on the support server; English is welcome in EN channels.
§4. Miyū bot and web dashboard
- §4.1. Command spam, automation (self-bots, mass scripts), and intentional infrastructure overload are forbidden.
- §4.2. Exploits, bypassing limits, manipulating votes, rankings, economy, Global Chat, or Premium are forbidden.
- §4.3. Bot configuration requires appropriate Discord permissions; guild owners/admins are responsible for lawful content on their servers.
- §4.4. The Operator may disable features, block a guild, or apply a global ban when needed for safety or Terms violations.
- §4.5. Report bugs in designated channels; false bug reports may be penalised.
- §4.6. The Operator does not guarantee uninterrupted bot availability; maintenance, updates, and Discord outages may limit features.
- §4.7. Use the API/dashboard only through authorised sessions; do not share session tokens with third parties.
§5. Privacy and safety
- §5.1. Data processing is described in the Privacy Policy: https://miyubot.xyz/en/privacy-policy
- §5.2. Do not post passwords, API keys, or sensitive data in public channels.
- §5.3. Scams, phishing, malware, and financial fraud result in immediate bans and may be reported to authorities.
- §5.4. The Operator may retain moderation and technical logs for security — see the Privacy Policy.
§6. Administration and decisions
- §6.1. The Administration may remove content, mute, kick, ban, and restrict access to Miyū services.
- §6.2. Community rule decisions are final, subject to mandatory consumer rights and law.
- §6.3. Abuse of reports, tickets, or support may result in penalties.
- §6.4. The Operator may move a case, refuse help, or end contact when staff are harassed.
- §6.5. A platform-wide Miyū ban may remove the bot from user guilds and block purchases.
§7. Penalties and sanctions
- §7.1. Penalties depend on scale, repetition, and intent.
- §7.2. Measures include: warning, mute, kick, temporary ban, permanent ban, global ban, Premium revocation, purchase blocks.
- §7.3. Penalties may be combined and applied without prior warning for serious violations.
- §7.4. Appeals against community penalties are not guaranteed; the Operator may review them voluntarily.
- §7.5. Server penalties do not exclude civil or criminal liability under applicable law.
§8. Payments, Premium and activation
This section covers payments made through miyubot.xyz (including the Premium page, Stripe Checkout and Stripe Customer Portal), voluntary support payments for the Miyū project, and digital benefits linked to the Miyū bot and support server.
Stripe acts as the technical payment provider. Miyū does not store full card details.
- §8.1. Clicking a button that starts checkout — including “Purchase server premium”, “Purchase account premium”, “Donate”, “Send a donation”, “Become a sponsor”, or equivalent in Stripe Checkout — constitutes an offer to enter a digital services agreement under these Terms and an obligation to pay the amount shown at checkout.
- §8.2. Payment must be completed (settled by the payment provider) within 24 hours of initiation. Failure to do so, abandoned sessions, repeated cancellations, or other abuse may result in refusal to activate benefits, a temporary or permanent ban on the Miyū support server, purchase blocks, and other measures under these Terms.
- §8.3. Server Premium, account Premium, and other paid features activate automatically after successful payment confirmation (e.g. webhook). Until then, benefits may not be granted — lack of instant activation is not grounds for a claim if payment was not completed or was declined.
- §8.4. Server Premium applies to one designated Discord server and requires the “Manage Server” permission. The user is responsible for correct server assignment; the operator may refuse or revoke assignment in case of abuse, fraud, or Terms violations.
- §8.5. Account Premium applies to benefits on the user’s Discord account (including Global Chat) and does not replace server Premium or vice versa unless explicitly stated otherwise.
- §8.6. Voluntary donations / sponsorship are one-time support. They may grant a Supporter role on the support server but are not server or account Premium unless clearly stated in the offer description.
- §8.7. Subscriptions (server Premium, account Premium) renew until cancelled in the Stripe Customer Portal or per Stripe rules. Cancellation does not refund the current billing period already paid for.
- §8.8. Premium trials, if available, are subject to limits shown on the site (e.g. once per user and/or server). The operator may deny, shorten, or revoke a trial in case of abuse.
- §8.9. Prices, plans, and Premium scope may change. Current prices are shown at purchase. Changes do not affect an already paid subscription period unless mandatory law requires otherwise.
- §8.10. Paid digital services are generally non-refundable after activation for user-side reasons (change of mind, unused features, removing the bot from a server). Refunds apply only where mandatory law requires or the operator agrees.
- §8.11. Chargebacks, false fraud reports, stolen funds, exploits, payment circumvention, or obtaining benefits without payment result in immediate revocation of Premium and other perks, bans, and reporting to the payment provider — without refund.
- §8.12. The operator may suspend or revoke Premium without refund if the user or server violates these Terms, Discord rules, law, or good practice, or when required for service safety.
- §8.13. The operator is not liable for Stripe, bank, or Discord outages or third-party delays, subject to mandatory law.
- §8.14. Premium benefits are a time-limited licence for the active paid period — they do not transfer ownership of software, the Miyū brand, or operator content.
- §8.15. Operator decisions on payments, server assignment, Premium revocation, and payment abuse penalties are final, subject to mandatory consumer rights.
§9. Intellectual property and content
- §9.1. The Miyū brand, logo, graphics, code, and site/bot text remain the Operator's or licensors' property.
- §9.2. Users retain rights to content they create; they grant the Operator a non-exclusive, royalty-free licence to process it as needed to provide the service (hosting, display, moderation, backup).
- §9.3. Copying, reverse engineering, reselling, or sharing Premium features with third parties without consent is forbidden.
- §9.4. The Operator may remove content that violates law, these Terms, or third-party rights.
§10. Liability and service availability
- §10.1. Miyū is provided on an "as is" basis within the limits allowed by law.
- §10.2. The Operator is not liable for indirect damage, lost profits, data loss on user guilds, or actions of Discord users — subject to mandatory law.
- §10.3. The Operator is not liable for content published by users on their guilds; guild administrators remain responsible.
- §10.4. The Operator's maximum liability to a consumer for paid services is limited to fees paid by the user in the last 12 months, unless mandatory law provides otherwise.
- §10.5. Force majeure (Discord, Stripe, Internet outages, DDoS) may suspend the service without compensation claims.
§11. Final provisions
- §11.1. Polish law applies to unregulated matters unless mandatory EU consumer law requires otherwise.
- §11.2. Translations may be provided; in case of conflict, the Polish version at miyubot.xyz/pl/terms prevails unless law requires otherwise.
- §11.3. Invalidity of one provision does not affect the rest.
- §11.4. Disputes should preferably be resolved amicably via Administration; consumers may use EU ODR and other out-of-court methods.
